Terms and Conditions
- Oxendale & Co. Limited trading as Oxendales, Simply Be & Jacamo, registered office: Woodford Business Park, Santry, Dublin 17 (“Promoter”) is holding a “Win €2,500 Tax Free” prize draw on 21st December 2022 (“Prize Draw”).
- To enter the Prize Draw, you must spend €40 or more in one single transaction with the Promoter (excluding any discounts applied at checkout, delivery charges or supplementary delivery charges) between 1st December 2022 and midnight on 20th December 2022 (“Qualifying Purchase”). Purchases made after midnight on 20th December 2022 will not be counted.
- A Qualifying Purchase can be made using your Oxendales personal account credit facility or by credit or debit card payment on the Oxendales website or mobile app.
- For each Qualifying Purchase made, you will automatically receive one entry into the Prize Draw. Multiple entries are permitted with each Qualifying Purchase equalling one entry. There will only be one Prize awarded per person regardless of multiple Qualifying Purchases.
- By making a Qualifying Purchase you agree to be bound by these terms and conditions ("Terms").
- The Prize Draw is open to all existing and new Oxendales brand customers who are Republic of Ireland residents aged 18 years or over, except: (i) employees of the Promoter; (ii) employees of agents or suppliers of the Promoter who are professionally connected with the Prize Draw or its administration; or (iii) family members of (i) and (ii) above.
- In entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim any Prize you may win. The Promotor may require you to provide proof that you are eligible to enter and does not accept any responsibility if you are not able to take up the Prize.
- There will be 1 winner of the €2,500 (“Winner”) selected at random by an employee of the Promoter on 21st December 2022 (“Draw Date”). The €2,500 will be paid to the Winner by way of BACS transfer to the Winner’s nominated bank account (“Prize”). If BACS transfer is not available an alternative payment method will be used which may result in the Winner receiving the Prize at a later date.
- The Prize is not negotiable, non-exchangeable and non-transferable.
- The Promoter will contact the Winner (using details the Promotor holds on their customer accounts) as soon as practicable after the Draw Date.
- The Promoter will make reasonable efforts to contact the Winner via phone and email. If the Winner cannot be contacted or is not available or has not claimed their Prize within 7 days of the date of the notification (or alternatively, refuses to accept the Prize) a new Winner will be selected following the process set out in paragraph 8 above.
- The decision of the Promoter regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered about it.
- The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation, the Winner’s surname and county can be obtained by sending an email to enquiries@nbrown.co.uk or by post for the attention of Tom Price, Griffin House, 40 Lever Street, Manchester, M60 6ES, within 30 days of the Draw Date.
- If you object to any or all of your surname and county being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority for Ireland on request.
- The Promoter reserves the right to refuse entry or refuse to award the Prize to anyone in breach of these Terms.
- The Promoter reserves the right to hold void, cancel, suspend or amend the Prize Draw where it becomes necessary to do so. The Promoter may notify any such withdrawal, alteration or suspension of the Prize Draw by posting a notice to that effect on www.oxendales.ie as soon as reasonably practicable.
- The Promoter will not accept responsibility for Qualifying Purchases that are not successfully completed, regardless of cause, including for example: equipment failure; technical malfunction or interruption; or systems, satellite, network, website, server, computer hardware or software failure of any kind. The Promoter does not take any responsibility for incomplete purchases and any incomplete purchases will not be considered Qualifying Purchases.
- Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
- The Winner may be required to participate in publicity related to the Prize Draw which may include the publication of their name and photograph in any media.
- Any personal data supplied with respect to the Prize Draw will be used in accordance with the Promotors Privacy Policy, which can be found on its website, and may be passed on to third party suppliers only insofar as required for fulfilment, delivery and/or arrangement of the Prize.
- If any provision of these Terms is held to be invalid or unenforceable all remaining provisions will remain in full force and effect.
- The Prize Draw and these Terms will be governed by Irish law and entrants to the Prize Draw submit to the exclusive jurisdiction of the Irish courts.
